Terms of Service

The Site is intended for a general audience and is not directed to children under 13. If you submit an email address to a waitlist, you represent that you are at least 13 years old, that the address is yours, and that the information you provide is accurate.

The Site presents projects, product pages, written posts, and gear lists, and allows you to join a waitlist to be notified about products in development. We may add, change, or remove content and features at any time, and we may discontinue the Site or any part of it without notice.

Joining a waitlist expresses interest only. It is not a purchase, an order, a reservation, a deposit, or a contract, and it creates no obligation on either side. Products described on the Site are under development. They may change substantially, be delayed, be offered in limited quantities, or never be released at all. Any price, specification, material, or timeline mentioned on the Site is an estimate and is not binding until a genuine checkout is presented and completed.

You agree not to:

• use the Site in violation of any applicable law or regulation;
• submit an email address that is not yours, or submit false, automated, or repeated entries to a waitlist;
• attempt to gain unauthorized access to the Site, its private areas, or its underlying systems, or to probe, scan, or test their security;
• interfere with or disrupt the Site, including through excessive automated requests, scraping that degrades service, or the introduction of malware; or
• copy or republish substantial portions of the Site for commercial purposes without our permission.

The Site and its contents, including the written posts, photographs, video, designs, product names, and the ohtimmi wordmark, are owned by ohtimmi LLC or its licensors and are protected by intellectual property laws. You may link to the Site and quote short excerpts with attribution. Reproducing, republishing, or distributing whole works, or using our content to train machine learning models, requires our prior written permission. We retain all rights not expressly granted.

You retain any rights you hold in the information you submit to us. By submitting it, you grant us a worldwide, non-exclusive, royalty-free license to store and use that information for the purposes described in our Privacy Policy, including contacting you about the product whose waitlist you joined. You are responsible for the accuracy and legality of what you submit.

The Site links to third-party websites and products, including gear recommendations. Where we participate in an affiliate program, we may earn a commission if you make a purchase after following one of those links, at no additional cost to you. Those links are marked as sponsored. Recommendations reflect our own opinion and are not paid placements unless expressly stated. We do not control third-party sites, we are not responsible for their content, products, or practices, and your dealings with them are solely between you and them.

Content on the Site is provided for information and entertainment only and is not professional advice of any kind. The Site describes activities that carry inherent and serious risk, including machining, fabrication, freediving, spearfishing, climbing, and other outdoor pursuits, and it describes equipment used in those activities. You are solely responsible for evaluating your own training, fitness, equipment, and conditions, and for complying with all applicable laws and regulations. Do not rely on the Site as instruction, and seek qualified training before undertaking any such activity.

The Site is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Site will be uninterrupted, secure, error-free, or that any content on it is accurate, complete, or current.

To the maximum extent permitted by law, ohtimmi LLC and its members, officers, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or relating to your use of the Site, whether based in contract, tort, strict liability, or otherwise, even if advised of the possibility of such damages. Our total aggregate liability arising out of or relating to these Terms or the Site will not exceed one hundred United States dollars (US $100). Some jurisdictions do not allow certain of these limitations, in which case they apply to the fullest extent permitted.

You agree to indemnify and hold harmless ohtimmi LLC from claims, damages, losses, liabilities, and expenses, including reasonable attorneys’ fees, arising out of your use of the Site, your submissions, or your breach of these Terms.

We may suspend or terminate your access to the Site at any time, with or without notice, if you breach these Terms or to comply with law. You may stop using the Site at any time. The provisions of these Terms that by their nature should survive termination, including Sections 5, 9, 10, 11, and 13, will survive.

These Terms are governed by the laws of the State of New York, USA, without regard to its conflict-of-laws rules. The exclusive venue for any dispute arising out of or relating to these Terms or the Site will be the state or federal courts located in the State of New York, and you consent to the personal jurisdiction of those courts, unless otherwise required by applicable law.

We may modify these Terms from time to time. If we make material changes, we will post the updated Terms with a new “Last updated” date. Your continued use of the Site after the changes take effect constitutes acceptance of the revised Terms.
